Duty of Care
…not the Naughty Step again?
Duty of care…and the naughty step
Duty of care was something we all learnt when we were young. Most of us learned the difference between right and wrong too.
We gradually learnt that it was OK to behave stupidly occasionally, but not at the cost of someone else’s pain and suffering.
We could happily cause accidents between cars, trucks and biscuit tins as we furiously whizzed around the kitchen floor, but if one of our trucks hit and hurt our baby sister or brother, we’d be on the naughty step and in trouble with mummy faster than we could say “I promise I won’t do it again mummy, I really promise…
Grow up and take responsibility…
Now then, most of us grow up into responsible adults that show a Duty of Care to our baby sisters…and to everyone else within society whether they are road users or whether they work in our office. Some people, however, continue to behave stupidly, recklessly, and thoughtlessly and by doing so they continue to harm those around them. If they grew up like the rest of us, the world would be an infinitely safer place.
But, many of these people get jobs and go on to carry out work incompetently; they are the epitome of unprofessionalism in the work place and cause untold havoc.

Duty of care and the steps to court
Duty of care is about taking reasonable care not to harm anyone in society with our actions. We drive safely, we do our jobs safely, we clean up dangerous materials safely and we take care not to harm other people.
But, some people take a pick ‘n’ mix approach to duty of care law and their legal responsibilities, and it is these people that our personal injury lawyers take to court on behalf of our injured clients. We work incredibly hard to ensure that people who do not take their duty of care responsibilities seriously, and cause serious personal injury and harm to our clients, get taken to court. And, once they are in court, our personal injury lawyers do not rest until they have won more of the compensation that our (perfectly responsible and upstanding members of society) clients deserve.

Duty of care and recklessness
Some people will always behave recklessly! They do not care about you, your family, your friends, your dog, your cat or your goldfish.
They do not care if they hurt you in a car accident or if they knock or crash into you in the street. They certainly do not care when you are in hospital with a serious head injury because of a car accident that they caused by talking on their mobile phone, while driving, to one of their equally reckless friends.
Duty of care is a life option…
We all have responsibilities. Most of these responsibilities actually become more meaningful of course when we become adults. We become legal responsible adults. Well, most of us do.
We can of course make various choices about how we want to live our life and what we are prepared to take responsibility for.
Let’s take a quick look at Mr Ricky Recklessness;

People think they can do what they want…
People do think they can do exactly what they want. The simple fact is that they cannot. They have exactly the same duty of care over everyone else as you do. It’s a dreadful shame that people like Ricky Recklessness have to learn all about their duty of care responsibilities in court though; after they have caused a perfectly law-abiding person, potentially life-threatening injuries.
Should you claim compensation?
Taking reasonable care not to harm others is a core element of our duty of care responsibilities to everyone in society. However, people like Ricky do behave recklessly and they can cause personal injuries to innocent people (going about their lives in a responsible and mindful manner). And, it is these people, who behave recklessly and cause injuries to our clients, who our personal injury lawyers take to court. Only you can decide if you want to make a claim and if you do, and your claim is accepted, we will support you every single step of the way.
