Non Fault Accident Claim

If you have been involved in accident which was not your fault, you will be entitled to make a non fault accident claim for compensation if you suffered an injury.

For a non fault accident claim to succeed, fault must be proved against or accepted by someone else (the third party).

Fault can be proved by establishing on the part of someone else:

If you think your accident was caused by someone else’s fault, then you have a right to make a non fault accident claim and you should consider doing so.

The first and most important step for a non fault accident claim to proceed is to determine who is at fault and if possible who they are insured with. This is usually quite an uncomplicated and clear-cut process although there are times when obtaining the required information and ascertaining who is at fault can take longer.

Road Accidents
For anyone involved in a car accident, motorbike accident, bicycle accident, pedestrian accident or any other type of road accident, our personal injury lawyers have electronic access to the DVLA to help us confirm the identify of the owner of a vehicle at fault.

They also have access to the Motor Insurers Database to enable them to identify the insurer of the driver or person at fault. If we determine that the person at fault is uninsured, we will work with the Motor Insurers Bureau (MIB) who will act on your behalf to pursue your claim.

Accidents in a Public Place
Where accidents happen in a public place we can access the Land Registry to determine the owner of the land or property where an accident occurred.

Accidents at Work
Where fault has been established for accidents that happen in the work place, we have access to an extensive back catalogue of data on companies and their insurers. Our process of bringing a non fault accident claim for a work accident against an employer or a business is a relatively simple process and which is designed to obtain an early admission of liability wherever possible.
